Action to recover damages for personal injuries resulting in the death of plaintiff’s intestate and alleged to have been caused by the defendant’s negligence, brought to the Superior Court in Fairfield County and tried to the jury before Shumway, J.; verdict and judgment for the plaintiff for $2,500, and appeal by the defendant.

At the close of the plaintiff’s evidence the defendant rested. The jury might reasonably have found upon the evidence submitted the following facts; indeed, the record would seem to indicate that any other finding would have been unreasonable:—

The defendant operates its railroad at Stamford over four main parallel tracks running east and west, and numbered from north to south, three, one, two, and four.
