Action to recover damages for negligence resulting in the death of the plaintiff’s intestate, brought to the Superior Court in New Haven County and tried to the jury before Bennett, Jverdict and judgment for the plaintiff for $4,500, and appeal by the defendant.

The defendant, in constructing an underground tunnel, had opened a perpendicular shaft extending fifty feet into the ground, and from its foot had driven a portion of the tunnel about two hundred and fifty feet in length in an easterly direction and about five hundred feet in a westerly direction, the portion extending to the east being known as heading No. 2, that extending to the west as heading No. 3.
