KRUEGER, Judge.
The offense is robbery. The punishment assessed is confinement in the State penitentiary for a term of five years.
Omitting the formal parts, it is charged in the indictment:
“That D. M. Etzler on or about the 12th day of July A. D., one thousand nine hundred and Thirty-nine and before the presentment of this indictment, in the County of Lynn and State of Texas, did then and there unlawfully in and upon G. E.
