*545In an action to recover damages for personal injuries, the defendant appeals from a judgment of the Supreme Court, Kings County (Saitta, J.), entered February 6, 2008, which, upon the denial of its motion pursuant to CPLR 4401 for judgment as a matter of law on the issue of liability, upon a jury verdict finding it 100% at fault in the happening of the accident, and upon a stipulation in which the parties agreed that the plaintiff sustained damages in the sum of $3,500,000, is in favor of the plaintiff and against it in the principal sum of $3,500,000.
