This is an appeal by plaintiffs, Lawrence Constantino and J. V. Sauro, president and secretary-treasurer, respectively, of Local 440, International Hod Carriers’, Building and Common Laborers’ Union, from a judgment made and entered by the superior court for King county, dismissing the complaint, after a stipulation had been entered into and filed by counsel for the respective parties that the testimony and exhibits introduced at the hearing .on the application for a restraining order would be the same as if the issues had been tried out on the merits.
