This is an action to recover certain moneys belonging to Slope county, which were deposited by the defendant Douglas, as county treasurer, in the First State Bank and the Slope County Bank of Amidon. The action is against both the county treasurer and the State Bonding Fund, as surety on his official bond. By stipulation the ease was tried before the judge of the district court without a jury. A judgment was rendered in favor of the plaintiff for $24,5Y6.51 plus interest and costs.
