Tbis appeal is from an order of tbe district court overruling tbe demurrer of tbe defendant State Bonding Bund to tbe plaintiff’s complaint. Tbe action is brought to recover on account of tbe alleged default of tbe defendant McIntyre as treasurer of the plaintiff county.
