Plaintiff-Appellant Rory Dolan filed a pro se complaint, pursuant to 42 U.S.C. §§ 1988 and 1985(3) and the New York State Constitution, alleging that employees of the New York Department of Corrections and Community Supervision filed a false misbehavior report and conspired against him, resulting in his 90-day confinement in the Special Housing Unit (“SHU”). The United States District Court for the Southern District of New York (George B. Daniels, /.), adopting the report and recommendation of a magistrate judge (Gabriel W.
