In this action.tbe plaintiff claims the exclusive right to the use of the waters of Salt creek, in Juab county. It alleges that about 1851 numerous persons residing on lands in and about Nephi appropriated all of its waters to then-irrigation, and agreed to act as an association; that they and their successors continued such appropriation until December 10, 1883, when a majority of them, with the knowledge and consent of all, incorporated under the name of the Nephi Irrigation Company; that afterwards, from time to time, all of them conveyed, or agreed to convey, their several…
