Kathleen Marin is a former employee of Xerox and a participant in the Xerox Corporation Long-Term Disability Income Plan (“LTD Plan”). The LTD plan is an “employee welfare benefit plan” under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1002(1). Plaintiffs last day at work for Xerox was in 1977. She stopped working due to a degenerative joint disease that has progressively worsened.
