David M. Nardy (Nardy) appeals from an order of the Court of Common Pleas of Delaware County that dismissed his petition for permission to appeal nunc pro tunc from an order of Department of Transportation, Bureau of Driver Licensing (DOT) that suspended his driving privileges for one year. Our scope of review of a trial court’s decision whether to allow an appeal nunc pro tunc is to determine whether the trial court abused its discretion or committed an error of law.
