The Mutuel Clerks’ Guild of Massachusetts, Inc. (“Guild”) has for many years been the collective bargaining representative for the approximately 400 employees of the Suffolk Downs Race Track (“Track”). The five Track employees involved in this lawsuit (“appellees”) had been Guild members in good standing prior to their expulsion from the Guild in 1969.
