The defendant was married to Nellie Crossley (née Atkins) April 23, 1929. At that time she was pregnant and charged that defendant was the author of her condition. Five months later the child was born and is still living. Defendant and Nellie lived together about three months when they separated, and in a short time went back together and again on the 28th day of January they again separated, as he claimed and testified on account of the infidelity of Nellie.
