The defendant was convicted of burglary and larceny, and appeals.

The charging parts of the information read as follows: .

“. . . did then and there unlawfully, wrongfully, willfully, feloniously and burglariously break and enter in the nighttime a store building in the city of Neodesha, Wilson county, Kansas, occupied and used by The Durnil Dry Goods Company as a retail store, where were kept and offered for sale goods, wares and merchandise, with intent to take, steal and carry away therefrom goods, wares and merchandise belonging to the said…
