Albert J. Horrell, the appellee, brought an action in the Marion Civil Circuit Court, charging, that “the Indianapolis Sun Company,” the appellant, on the 8th day of August, 1874,’at, etc., maliciously intending,etc., “did write, print and publish, and cause to be written, printed and published, in a certain newspaper, called the ‘Indianapolis Sun/ a certain false, scandalous and malicious libel, of and concerning the said plaintiff” (appellee), “which false, scandalous and malicious libel is as follows, to wit:
