OPINION

LYDON, Judge:

This case comes before the court on plaintiffs motion to transfer the case to the District Court for the District of Colorado (District Court). In support of this motion, plaintiff states that this court lacks jurisdiction over the cause of action set forth in the complaint, as amended, since said action does not seek money damages from the United States. A reading of plaintiff’s second amended complaint supports plaintiff’s statement.1 Defendant opposes said motion.
