Atlas, J.), rendered August 2, 1989, convicting defendant, after jury trial, of two counts of attempted criminal possession of stolen property in the fourth degree, and sentencing him to concurrent terms of imprisonment of six months and a $2,000 fine, unanimously affirmed. The matter is remitted to the Supreme Court, New York County, for further proceedings pursuant to CPL 460.50 (5).
