In this putative class action, Plaintiff Vinny’s Landscaping, Inc., (“Plaintiff”) alleges that Defendants violated the Telephone Consumer Protection Act (the *747“TCPA”), 47 U.S.C. § 227, as amended by the Junk Fax Prevention Act of 2005 by sending an unsolicited facsimile advertisement to Plaintiff and a class of similarly situated persons.
