BURCH, J.:

The plaintiff prosecutes error from an order denying him a temporary injunction restraining-the defendant street-car company from locating its. track near the curbing on the side of a street in front of his property instead of in the center of the street.

Chicago avenue, or Douglass avenue, of which it is. merely an extension, runs east and west in the city of' Wichita and crosses the Arkansas river. West of the-, river the street is seventy-six feet wide from curb to curb. The space between the curbing and the property- ■ line on each side is…
