Ritz, Judge:

In the year 1907 the defendant Alkire Orchard Company was formed. The plaintiff.was active in.the organization of this company. He was interested in it as a stockholder, and *527at its organization be was made its manager at a salary of fifty dollars a month. He continued to be its manager under an appointment from the board of directors from the time of its organization until the fall of 1912. His salary as manager had been increased from time to time, but in the fall of 1912 he conceived the idea that he was not being paid sufficient compensation for his services. The defendant…
