This suit was instituted by the appellee, L. E. Goodrich, in the district court of Grayson county, Tex., against the appellant, Missouri, Kansas & Texas Railway Company, to recover damages for personal injuries sustained by him through the negligence of appellant. Plaintiff alleged that he was a citizen of the state of Kansas, and that appellant was a citizen of the state of Kansas and engaged in the business of common carrier of freight and passengers, and owning and operating .various lines of railway extending through the state of Kansas, the state of Oklahoma, and into Grayson county,…
