State v. Palm
Supreme Court of Connecticut
1Opinion of the CourtAvery, J.
The accused was charged with murder in the first degree in having shot to death while attempting to perpetrate the crime of robbery, Peter W. Kaminski, at Milford, on October 3d, 1936. He pleaded not guilty and elected to be tried by the court instead of by the jury. The court after trial found him guilty of murder in the first degree as charged and the accused has appealed. In accordance with our practice, the trial court has made a finding of the subordinate facts upon which it based its conclusion that the accused was guilty as charged. State v.
