MEMORANDUM OPINION
PAYNE, District Judge.
Sally M. Parkerson (“Mrs. Parkerson”) instituted this action by filing in the Circuit Court for the City of Newport News, Virginia a motion for judgment alleging that Federal Home Life Insurance Company (“Federal Home”) breached the terms of a life insurance policy it issued in the amount of $100,000 on the life of William W. Parkerson (“Mr. Parkerson”). The breach is alleged to have occurred when, following Mr. Parkerson’s death on May 12, 1990, Federal Home denied Mrs. Parkerson’s claim for the insurance proceeds; notified her that the policy was…
