On the 19th day of November, 1958, in the District Court of Okfuskee County, State of Oklahoma, plaintiff was granted a judgment, by default, against Howard Bennett for the sum of $25,000 for pain and suffering and personal injuries sustained in an automobile collision between a car driven by the defendant, James H. MeMillen, and a car driven by Wiley Edward Brewer, Chief of Police of the Town of Okemah, Oklahoma.
