1. W. D. Stribling, who ran a garage in Eatonton and who was agent for the defendant in that city, was placed upon the witness-stand by the plaintiff. The plaintiff’s counsel at the time stated to the court that the witness was an agent of the defendant, and that the plaintiff desired to examine him as an adverse party. Whereupon counsel for the defendant stated that the witness was not a party to the ease, and objected to the plaintiff’s cross-examination of him.
