A. F. Martin Jr. brought suit against W. E. Hale upon a note for the principal sum of $1,092, claiming only $500 *229principal to be clue thereon. The note was payable to the Bank of Ringgold, and transferred without recourse by the .payee to the plaintiff. The defendant admitted the execution of the note, and that the plaintiff was the owner thereof. By way of defense he alleged that the plaintiff was the cashier of the Bank of Ringgold, and came to the home of the defendant, who at the time was sick in bed, and represented to the defendant that a note given by him. to the Bank of Ringgold had…
