BORAH, Circuit Judge.

The plaintiff, Commercial Credit Corporation, as assignee of Lenal Company, Inc., hereinafter called Lenal, brought this action against Milton W. Pepper, Florence M. Pepper and Leonard Pepper, as partners doing business under the firm name of Pepper Sup-ply Company, to recover the sum of $67,291.25 allegedly due -plaintiff’s assignor. A trial on the merits was had and at the close of all the evidence the plaintiff moved for a directed verdict.
