This suit was brought by Henry Dunn and others, the defendants in error, against the Lamar-Delta County Levee Improvement District No. 2, seeking relief by way of damages for injury to lands of the defendants in error, which is alleged to have resulted from certain drainage improvements constructed by said district. From a judgment rendered by the trial court in favor of the defendants in error, the levee improvement district appealed to the Court of Civil Appeals. 42 S.W.(2d) 872.
