This is an action in equity brought in the district court of Winona county for specific performance of certain exécuted oral contracts. The defendants appeal from an order overruling their demurrer to plaintiffs’ complaint.

It appears from the complaint that in 1878 and 1881, respectively, Isaac B. Cummings and Caroline F. Cummings, his wife, who were without issue, admitted their nieces Ella M. Yeaton and Annie O. Yeaton (now Annie O. Miller), minors, into their home, at Winona, and that said minors ever thereafter, until the death of the former, continued to reside therein as members of the…
