This case is before us on remand after the Supreme Court, in lieu of granting leave to appeal, ordered the Court of Appeals to consider the matter as on leave granted, 412 Mich 868 (1981).

It was previously determined by the Workers’ Compensation Appeal Board (WCAB) that plaintiff received a compensable injury on June 7, 1966. A decision by a hearing referee granted plaintiff an open award on September 2, 1969, and was affirmed by the WCAB.
