This is an appeal from a judgment in favor of plaintiff and from an order denying defendant’s motion for a new trial, in an action brought by plaintiff to recover damages on account of breach of alleged warranty, fraudulent representations, and fraudulent concealment, in. the sale to plaintiff and four other persons, who have assigned their claims to plaintiff, of certain seed barley for the season of 1906-7. The trial resulted in a verdict and judgment for plaintiff in the sum of $12,155.21.
