In an amended information filed in the District Court for Sheridan County, George Mills, the defendant and appellant herein, was charged with uttering a forged bank check under section 28-601, R. R. S. 1943; and with being a habitual criminal under section 29-2221, R. R. S. 1943. Trial commenced on August 16, 1976, before a jury, which found the defendant guilty of uttering a forged bank check. After a separate hearing before the trial court on the charge of being a habitual criminal, as provided for in section 29-2221 (2), R. R. S. 1943, the defendant was found guilty on that charge.…
