This is an appeal from the trial court’s denial of a motion to dismiss a complaint.

Mast’s complaint alleged that Olsen executed a bond for release of property belonging to Davis which had been attached; that under the release bond Olsen agreed to pay Mast on demand the amount of a judgment not exceeding $14,586.50 which Mast might recover against Davis; that judgment was entered in Mast’s favor against Davis in the amount of $8,473.02; and that Olsen refused to pay Mast that sum.
