Plaintiff brought this suit for damages alleging defendant did unlawfully cause one Ralph Powers to breach his contract with plaintiff to sell him certain described stock; and in a second count that defendant did unlawfullly induce said Ralph Powers not to contract with plaintiff concerning the sale of said stock. Issue was joined May 20, 1930. Substantially a year later, and evidently as trial of the case was being approached, plaintiff moved that the hearing be adjourned until after May 25, 1931, upon showing that said Ralph Powers was an indispensable witness; that he was in California…
