MEMORANDUM OPINION AND ORDER

BRODERICK, District Judge.

In this action the plaintiffs challenge the validity of § 6170, Appendix III of the Regulations of the Pennsylvania Department of Public Welfare 1 which provides emergency assistance payments to needy recipients for special needs resulting only from civil disorders or natural disasters. The plaintiffs contend that § 6170, Appendix III violates the Social Security Act, 42 U.S.C. §§ 603(a)(5) and 606(e) and federal regulation 45 C. F.R. § 233.120.
