The Salvation Army appeals an order granting Albert D. Dixon’s motion for summary judgment in Dixon’s action for declaratory relief.
The facts of this case are not in dispute and the parties agree summary judgment is an appropriate method to resolve the issues (Code Civ. Proc., § 437c, subd. (c)). Dixon and the Salvation Army entered a real estate purchase and sale agreement.
