This suit for specific performance was transferred by Division Two to the Court en Banc because of the dissent of one of the Judges. We adopt the statement of facts, the statement of the contentions of the *584parties and the ruling on the validity of the contract involved from the Divisional opinion as hereinafter set out without quotation marks.
