This matter comes before the Court on the joint motion of the defendants, Boch Oldsmobile, Inc. (“Boch”), Ernest Boch, Sr. (“Ernest, Sr.”), Ernest Boch, Jr. (“Ernest, Jr.”) and Helen Smith, for summary judgment pursuant to Mass.R.Civ.P. 56. On October 28, 1992, the plaintiff, MaryBurman, filed a complaint containing seven counts against the various defendants.
