I. INTRODUCTION
Plaintiff Delaware Health Care, Inc. (“Delaware Health”) has filed this action alleging that MCD Holding Company (“MCD Holding”), MCD Foundation (“MCD Foundation”) and its subsidiaries, The Medical Center of Delaware, Inc. (“Medical Center”) and Visiting Nurse Association of Delaware (“VNA”), have violated the Sherman Act, 15 U.S.C. §§ 1 and 2, the Clayton Act, 15 U.S.C. § 18, and state law for tortious interference with contractual and prospective contractual relations.
