Mastercrafters Clock & Radio- Co., (here- • inafter called plaintiff), filed its complaint; *695against Vacheron & Constantin-Le Coultre Watches, Inc., (hereinafter called defendant), wherein it was alleged the facts on which the jurisdiction of the court is found and the following: Prior to July, 1952, plaintiff designed an electric clock which, since that date, it has sold throughout the United States under the trademark “Mastercrafters” “Mastertime” clock, Model No. 308.
