HARPER, Judge.
Appellant was convicted of murder and his punishment assessed at five years confinement in the State penitentiary, from which judgment he prosecutes this appeal.
It appears that appellant and deceased had been friends for many years until about April of last year. Deceased was a member of the mercantile firm of Murphy Bros., doing business at Maud, in Bowie County the members of the firm being Al Murphy and deceased, Lee Murphy.
