Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life; hence this appeal.
Appellant assigns as error the action of the court overruling his motion for continuance. There being no bill of exceptions presenting this error, the same can not be considered. He also complains of the action of the court admitting the evidence of Tide Cude. It appears from the bill of exceptions that appellant and Hde Cude were confined in jail in the same cell, defendant being incarcerated on this charge and Cude for another…
