McCORD, Judge.
This is an appeal from a conviction for murder in the second -degree with a penalty of thirty-five years. On the 13th day of June, 1909, and on the night of said day, one Jake Boss, a negro, was living on the place of one Jackson, as tenant. This place was situated not far from the town of Coolidge, in Limestone County. On that night the said Boss gave a “festival,” and there had assembled a good many negroes of the neighborhood.
