In cause No. 13842 in Franklin County, Eichmeier, defendant here, was plaintiff and Marshfield Homes, Inc., plaintiff here, was one of the defendants. A default judgment was entered against Marshfield for failure to appear. It brought this action in equity for a declaratory judgment seeking a determination that the default judgment in cause No. 13842 was null and void for lack of jurisdiction.
