This is an appeal from the decision of the Board of United States General Appraisers, and was removed to this court from the United States Circuit Court for the Southern District of New York.
The appellants in 1908 imported certain gloves which were assessed by the collector as dutiable by similitude as wearing apparel made of *87silk, under paragraph 390 of the act of July 24, 1897, the material part of which is as follows:
