The petitioners, The W. E. Long Co.-Independent Bakers’ Cooperative, an association, Don F. Copell, its President, and Betsy Ross Bakeries, Inc., in this original proceeding in mandamus instituted in this Court on April 2, 1962, seek a writ to require the defendant, the Honorable Joe F. Burdett, Secretary of State of West Virginia, to register and deliver a proper certificate for the trade-mark known as “Flavor-Spun” in the name of The W. E.
