Judy Shockey, the Special Administratrix of the estate of Bessie Mae Moss, appeals from a judgment entered on a jury verdict for the plaintiff, Gordon McCamley, in a personal injury case arising under Nebraska law. 1 In 1978 this court set aside a summary judgment granted the defendant on the ground that there was a sufficient dispute of material fact whether the parties were under a mutual mistake of fact, when they executed a release, as to the extent of the injuries McCamley received when his automobile was struck from the rear by Moss.
