STATEMENT OF THE CASE

Plaintiffs have filed a motion to remand this case to the Second Judicial District Court of the State of Nevada. They argue that this Court lacks subject-matter jurisdiction of the case and that, therefore, removal to this Court was improper. See 28 U.S.C. § 1447(c).

The basis for the defendants’ removal to this Court was the presence of the Federal Savings and Loan Insurance Corporation (“FSLIC”) as a defendant. Plaintiffs are not suing the FSLIC for any act or omission committed by that entity as a federal agency. Instead, the suit…
