Plaintiff, while in the course and scope of his employment, was injured as a result of an accident with an under-insured motorist. Plaintiff obtained workers’ compensation benefits from defendant, Liberty Northwest Insurance Corporation, his employer’s workers’ compensation insurer, and later accepted underinsured motorist (UIM) benefits from Nationwide Insurance Company of America, which insured the car in which plaintiff was a passenger. Plaintiff then filed this declaratory judgment action, seeking a declaration that he is not required to reimburse Liberty Northwest from UIM benefits…
