Plaintiffs RX Pharmacies Plus, Inc., Rei-gert Corporation, and Tobin’s Pharmacy, Inc. (collectively the pharmacies), and Elisio Nie-to, Chester Puderbaugh, Karen Luna, and Lydia Herrera (collectively the Medicaid recipients), commenced this action against various officials of the State of Colorado and the Colorado Board of Social Services (collectively Colorado or the state.)
